By accessing or using this website, you agree to these terms. If you do not agree, please do not use the website or submit information through it.
These are website terms, not the complete terms on which Legacy Estate Media supplies paid marketing services. Any service engagement will be governed by a separate written proposal, scope or agreement accepted by the relevant parties.
2. Website purpose
This website provides general information about property-demand-generation and marketing services for South African real estate professionals. The content is intended to help prospective clients understand our approach and decide whether to request a conversation.
Website content is not legal, financial, tax, property-valuation or investment advice. You should obtain appropriately qualified advice for decisions requiring it.
3. Enquiries and appointment bookings
You must provide information that is accurate to the best of your knowledge and that you are authorised to provide. Submitting an enquiry or booking a call:
- does not oblige either party to enter into a service agreement;
- does not reserve advertising inventory, territory exclusivity or campaign capacity;
- does not constitute acceptance of a proposal or create an agency, partnership or employment relationship; and
- does not guarantee that we will be able to offer services for a particular market, objective, timeline or budget.
Please give reasonable notice if you need to cancel or reschedule a booked call.
4. Paid services require a separate agreement
Campaign scope, fees, advertising spend, payment terms, platform access, intellectual-property rights, data responsibilities, timelines, cancellation rights and service deliverables will be set out in the written agreement applicable to that engagement.
If these website terms conflict with a signed service agreement, the signed service agreement governs the paid services to the extent of that conflict.
5. Payments and billing authority
Where a client adds a payment method through PayFast, the client authorises Legacy Estate Media to process amounts that become due under the applicable signed service agreement. These may include recurring management fees and any separately calculated and invoiced performance bonus or additional agreed service fee.
Charges must correspond with the written fee arrangement and an invoice or billing notice. Adding a payment method does not authorise fees outside the agreed scope. PayFast, rather than Legacy Estate Media, receives and stores the client's card details. We may retain PayFast's tokenised payment reference for authorised future charges.
A client may withdraw the payment authorisation for charges not yet processed by emailing info@legacyestatemedia.co.za. Removing or cancelling a payment method does not by itself cancel the service agreement, change its notice period or remove any amount already due.
6. Client data and follow-up responsibilities
Property professionals who engage Legacy Estate Media remain responsible for using campaign leads and personal information lawfully. Unless a signed service agreement states otherwise, a client that determines the purpose and means of processing will act as the responsible party, and Legacy Estate Media will act as an operator only for the processing carried out on the client's documented instructions.
Clients must:
- provide accurate business information and only give us data, audiences or platform access they are authorised to use;
- give prospective buyers, sellers, landlords and tenants any privacy notices required by law;
- contact leads for legitimate property-related purposes, identify themselves accurately and avoid misleading or excessive communication;
- honour objections, marketing opt-outs, correction requests and deletion requests where applicable;
- protect CRM accounts, advertising platforms, exported lead files and login credentials against unauthorised access; and
- not sell, disclose or repurpose lead information in a way that is unlawful or inconsistent with the notice given to the person.
Detailed instructions, security responsibilities, retention arrangements and incident procedures may be included in the applicable service agreement or data-processing terms.
7. Advertising and business results
Advertising performance, lead volumes, lead quality, appointments, mandates, transactions, commission and return on advertising spend are not guaranteed. Results can be affected by factors outside our control, including market conditions, property supply, offer strength, advertising budget, platform delivery, competition, response time and follow-up.
Examples, strategies and market scenarios on this website are explanatory. They should not be read as a promise that the same approach or outcome will apply to every area or client.
8. Acceptable use
You may not use this website to:
- submit false, misleading, unlawful or unauthorised information;
- attempt to access systems or data without authorisation;
- introduce malicious code, overwhelm the website or interfere with its operation;
- scrape, reproduce or commercially exploit substantial website content without permission; or
- infringe another person’s privacy, intellectual-property or other legal rights.
9. Intellectual property
Unless stated otherwise, the website’s original copy, layout, branding, graphics and other materials are owned by or licensed to Legacy Estate Media and are protected by applicable intellectual-property laws.
You may view and print reasonable extracts for your own internal evaluation. No other reproduction, adaptation, publication, resale or commercial use is permitted without prior written permission.
10. Third-party links and services
The website may contain links to or embedded services supplied by third parties, including appointment-booking and video-conferencing providers. Their availability, security, content and privacy practices are controlled by those providers, not by Legacy Estate Media.

11. Availability and limitation of liability
We aim to keep the website accurate, secure and available, but we do not promise that it will always be uninterrupted, error-free or current. We may correct, update, suspend or withdraw website content when reasonably necessary.
